This Privacy Policy ("Policy") applies to the collection, access, use, or disclosure of personal information by us (XOHM) anytime you interact with us, such as when you visit our Web site, when you purchase or use our products and services, or when you contact Customer Care. For any international user of Xohm services, your personal information is processed and stored in the United States and is subject to U.S. law. We may change this Policy at any time and the revised policy will apply to any information collected to date. The revised Policy will be posted on the Web site, indicating the date it was last updated. We encourage you to review this Policy whenever you visit our Web site.
We collect personal information about users of XOHM products or services in the normal course of our business. Personal information is information that we, as part of our business practice, directly associate with a specific person such as name, address, telephone number, e-mail address, activities, location information, and personal preferences. Personal information does not include information that doesn’t identity you. This is called aggregate information.
For our business and government customers, the account holder is the entity that buys the service or product for its employees or other authorized users. This means, if you (as the user of a device) receive service, certain pricing, terms or other benefits through a business or government customer's agreement with us, that business or government customer may request and obtain from us registration and other information related to your use of our services.
Here are some examples of the types of personal and other information we collect and when we collect it. You should refer to the rest of this Policy to see how we use, disclose and protect that information.
Information You Give Us: We collect personal information when your purchase our products, sign up for or use our services, or when you email, call or otherwise communicate with us. This information may include, for example, billing and credit information, shipping and/or billing address and phone number, email address, date of birth, and social security number or other government identification number. You may also provide us with information when you apply for a job, respond to surveys or enter contests and promotions. The types of information we collect from time to time will evolve with our technologies and services.
Sometimes you may supply personal information about others, which we have not requested—for example, if you share a picture or video of yourself with a XOHM service and others, or if you supply us with the contact information for a friend and ask us to send something to that friend. Remember that many of our technologies are server-based. That is, when you store information, it may be stored on one of our, or our service provider’s, servers (and not on your device). Please do not store or supply personal information about others unless you have obtained their informed consent to do so.
Information that we automatically collect: We automatically receive certain types of information whenever you interact with us through XOHM services or our Web sites. For example, we may collect your device’s IP address, the date and time of your access, the type of browser you use and other information about its operating system, your location, and the Website from which you came and then went. When you browse the wireless Web or use our services, our systems generally know about your use of our products and services, like when your wireless device is turned on, where it is located, what device you are using, how you are using it, and what Websites you visit.
We may use systems and tools to monitor your use of XOHM sites for analytical purposes. For example, we allow collection by analytic service provider(s) of site click-stream and cookie data to help us track aggregate and individual use of our Site, the Portal and the Xohm service; and determine possible interests of users and ways to improve our Sites, products and services.
Information that third parties collect: Some services may be offered through us by third parties. IF YOU PROVIDE PERSONAL INFORMATION TO ANY THIRD PARTY OR USE THIRD PARTY SERVICE, YOU SHOULD REVIEW THAT THIRD PARTY'S PRIVACY POLICIES BEFORE PROVIDING INFORMATION OR USING THE SERVICE. Information Collected Via Advertisements: Some advertisers on the XOHM portal or service might use their cookies on our Site or in their messages to you. If you click on an advertisement, a cookie might be placed on your device. To find out how these kinds of companies tend to collect and use personal information or what your choices are for that use and collection, visit their sites to see their privacy policies. Visit networkadvertising.org to see a list of advertisers that typically serve these kinds of ads and to exercise your choice. We do not control these advertising companies and their practices. Their policies may change over time.
Information from Other Sources: We may obtain information from outside sources to combine with your personal information. For example, we may receive credit information when you initially subscribe for the XOHM service. We also may use commercially available information from third parties to help us better serve you or inform you about products or services that we think will interest you. We often receive information from the dealer from whom you purchase your XOHM device prior to initiating service with us. We may receive personal information from those application service providers that bring you services through the XOHM network and with whom you subscribe.
We use personal information for a variety of purposes, such as to provide products and services, and to do all the things that are normally associated with the provision of those products and services. We use your personal information to do things like:
Service Providers: We may share personal information with a trusted third party for the third party’s use to complete a transaction you have requested or to perform services on our behalf. When the third party acts solely on our behalf, we do not allow it to use the personal information for other purposes. For example, when service providers process and print your billing statement on our behalf, they may only use the personal information to produce the billing statement.
Your Disclosures to Third Parties Through Our Services: You may choose to take advantage of services and products offered by third parties through our services, and may otherwise disclose personal information to third parties in the course of using our services. In each case, you will be providing information directly to the third party, and any personal information you provide will be governed by its terms, conditions, and policies—not this policy. For example, if you roam on another carrier’s wireless network, information about your usage and the numbers you dial will be available to the carrier providing the service. As another example, if you use a “widget” or make a purchase using our mobile Internet service, you may disclose personal information directly to the company providing the service or facilitating the transaction such as the merchant bank and the merchant. Also, if you create a profile in a game, social networking application, or other application or service, post any information in public areas, or communicate directly with other users with our products or services, any personal information you disclose through those activities will be available to third parties. Contests and Promotions: Personal information you provide to participate in contests, sweepstakes or other similar promotions will be used for the purpose of administering the promotion and may be disclosed to other sponsors as a condition of participation. You should check the promotion’s rules to determine how personal information will be used and shared with others. Some states require that the names and other information regarding contest and sweepstakes winners be filed with a state agency.
Business Transfers: Personal information about our users may be disclosed as part of any merger, acquisition, sale of company assets or transition of service to another provider, as well as in the unlikely event of an insolvency, bankruptcy or receivership in which personal information would be transferred as one of the business assets of the XOHM business unit.
Protection of XOHM and Others: We may access, monitor, use or disclose your personal information or communications to do things like (1) comply with the law; (2) protect the rights or property of us and our customers; (3) respond to emergencies; (4) initiate, render, bill, and collect for services; or (5) facilitate or verify the appropriate calculation of taxes, fees, or other obligations due to a local, state, or federal government requirement; or determine eligibility for government benefits.
We do not knowingly collect personal information from children under the age of 13 without parental or guardian consent. If your child under 13 has provided personal information without your consent, you may inform us by writing us at our address for legal notices (see the Terms of Use) or by contacting us at (877) 333-XOHM (9646). We will use commercially reasonable efforts to delete that information from our databases.
To make XOHM wireless communications possible, our network knows the general location of your XOHM device whenever it is turned on. This location sensitivity is necessary to make wireless communications possible and to provide the location-enabled services that are available through XOHM.
XOHM offers unique features, including a number of location-enabled services. To provide these services, the XOHM network must automatically collect the location information of your device to deliver your services. In addition, the location-based information permits us to better understand your usage patterns and preferences in order to develop and inform you about additional XOHM and third party services that may interest you and others.
We may also use your location information to create anonymized data from which your personally identifiable information has been removed or obscured. You should carefully review the privacy policies of third parties with whom you have authorized the sharing your location information, and you should understand the risks involved in disclosing your location information to friends or other people. It is your responsibility to inform anyone that uses your wireless device and all of the users on your account of that device’s location capabilities and the location based services that are in use. You should review the terms and conditions and privacy policies for each location-based service you use so that you can make a fully informed decision about whether to use it.
Other Location Identifiers: Your XOHM service may also be personalized using your zip code or other location identifiers. We use this information to serve you relevant content, and we treat the information like any other personal information under this Policy.
Our sites contain cookies or other tracking mechanisms that collect information. Cookies are small files placed on your device’s hard drive when you visit our sites. These files identify your device and record your preferences and other data about your visit so that the site recognizes your device and can personalize your visit when you return. For example, cookies enable a Website shopping cart to function so that you only have to check out once. Cookies are often tied to the use of personally identifiable information while using our site, which means that some of its utility may be lost if you choose not to accept the use of cookies.

Cookies are also used by our suppliers and third party vendors to facilitate the various services and information offered. Depending on the XOHM device or service being used, cookies may be stored locally on the device, or on servers operated by a service provider. This Internet cookie-like functionality does the same thing as the cookies on your device, as described above. Each site you visit is controlled by a separate company, which means their individual privacy policies will govern their cookies and any information you voluntarily provide.
You may disable some cookies, but XOHM cannot guarantee that all the features of its sites will function properly or that all services will be available.
XOHM may place Web beacons on its sites in conjunction with cookies to see how visitors are navigating and/or interacting with those sites. A Web beacon, also known as a Web bug, is a small, graphical image on a Web page, Web-based document or in an e-mail message that is designed to allow the site owner or a third party to monitor the address and other information of the site viewing the item. Web beacons are often invisible to the user because they are typically very small (only 1-by-1 pixel) and the same color as the background of the Web page, document or e-mail message. Web beacons are represented as HTML IMG tags in the Web page. Users can click on "view profiles" of the Web page to see whether the page is using a Web beacon. Web beacons collect the IP address of the computer to which the Web beacon is sent, the URL of the page on which the Web beacon is placed, and the time it was viewed. Web beacons can also be linked to personal information.
XOHM may use third-party advertising companies to place advertisements about our products and services on other Websites. The advertising companies may use cookies and other technology such as Web beacons or tagging to facilitate those ads. The use of those technologies is subject to the advertising company's privacy policy, and not the policy of XOHM.
We maintain a variety of physical, electronic, and procedural safeguards to guard your personal information.
For example, when you are ordering new services or products through the XOHM Site, we employ the Secure Sockets Layer (SSL) protocol for the transmission of the information from you to us. You should be aware that XOHM has no control over the security of other sites on the Internet you might visit, interact with, or from which you buy products or services.
Your Account Security: You should keep your user name, password (which may include a shared secret) or other access information safe and confidential to protect against unauthorized access to your account information and services. We encourage you (the account holder) to ensure the privacy of your account information by establishing a confidential password. Your password will be used when you access your account. We treat the holder of your authenticating credentials as an authorized person on your account. Please do not share your authentication credentials with anyone whom you do not wish to access your account.
XOHM retains records containing personal information for as long as there is a business or legal need for it. XOHM destroys those records in compliance with the law.

XOHM is part of Sprint Nextel and it shares personal information between Sprint Nextel affiliates and marketing agents for marketing purposes. California residents can request the categories of personal information XOHM shares with its affiliates during the previous calendar year. To make your request, send an email to officeofprivacy@sprint.com. Written requests may be sent to the Office of Privacy - Legal Department, Sprint Nextel, P.O. Box 4600 Reston, VA 20195. XOHM will respond to these requests for the list within 30 days. Requests that come to XOHM by other means may result in a delayed response. If XOHM has shared personal information with unaffiliated parties in the prior calendar year for those parties to independently market their own products and services, we will provide a list of the companies as well.
